Motorcycle Accident Cases We Accept

If you’ve been injured in a motorcycle accident, you may be facing medical bills, lost wages, and an overwhelming legal process. Our firm is here to help you navigate your claim, determine liability, and fight for the compensation you deserve. Whether your accident was caused by a negligent driver, dangerous road conditions, or another factor, we have the experience and resources to build a strong case on your behalf.

  • Accidents Caused by Distracted Drivers. When drivers are texting, eating, or otherwise distracted, they often fail to see motorcycles, leading to serious collisions. If a distracted driver caused your accident, we can help gather critical evidence, such as police reports, phone records, and witness statements, to prove their negligence. Our attorneys will handle negotiations with the insurance company to ensure you receive full compensation for your medical expenses, lost wages, and pain and suffering.
  • Failure to Yield Accidents. Many motorcycle accidents occur when drivers fail to yield the right of way, especially at intersections or when making left turns. If you were hit by a driver who failed to yield, we can use traffic camera footage, accident reports, and witness testimony to establish fault. Our legal team will fight to hold the responsible party accountable and seek maximum compensation for your injuries.

Recovering Compensation After a Motorcycle Accident

Motorcycle accidents often leave victims facing significant financial burdens. From costly medical bills to time away from work, the expenses can quickly become overwhelming. Pursuing compensation through a personal injury claim can help you recover damages and begin to rebuild your life. We help victims of motorcycle wrecks seek compensation to cover things like:

  1. Medical Expenses. You can seek compensation to cover the cost of hospital stays, surgeries, rehabilitation, physical therapy, and any ongoing care needed for your recovery.
  2. Lost Income and Earning Capacity. If your injuries prevent you from returning to work, you may be entitled to compensation for lost wages and future earning potential.
  3. Property Damage. Replacing or repairing your motorcycle, as well as any gear or equipment damaged in the accident, can be covered in the money awarded to you in a motorcycle accident lawsuit.
  4. Pain and Suffering. Beyond financial losses, you may be compensated for the physical pain, emotional distress, and reduced quality of life resulting from the accident.
  5. Punitive Damages. In cases involving gross negligence or intentional misconduct, punitive damages may be awarded to punish the at-fault party and deter similar behavior.

What if I Was Partially at Fault for the Accident?

In South Carolina, you can still get compensation after a motorcycle accident if you were partly responsible for the wreck. As long as you were not more than 50% at fault, you can recover damages.

The amount you receive will be reduced by your level of fault. For example, if you were found to be 20% responsible for the accident, the total amount you receive would be reduced by 20%.

Working with an experienced motorcycle accident attorney is the best way to understand what compensation you may be eligible for and to get guidance in pursuing the amount you deserve.

What Is South Carolina’s Statute of Limitations for Motorcycle Accidents?

In South Carolina, you usually have three years from the date of the motorcycle accident to file a claim. This means that if you don’t take legal action within three years, you lose the chance to recover money for your medical bills, lost income, and other damages caused by the crash.

The three-year time limit starts on the day the accident happened. If you miss that deadline, the court will likely dismiss your case, meaning you won’t get any compensation. That’s why it’s important to start the process as soon as possible. However, there are exceptions. For example, if the injured person is a child or if the injury wasn’t obvious right away, the time limit might be extended. But these situations are not common, and it’s best not to rely on them.

Talking to a lawyer quickly after your motorcycle crash can help ensure everything is done on time and you don’t lose your right to recover what you’re owed.
